Terms of service - DepositMonsters

These terms set out the rules for using the DepositMonsters mobile game and the services provided in it by electronic means, including the sale of the licence that removes adverts. Creating an account means accepting this document.

General provisions

The service provider and publisher of the game is [NAZWA FIRMY - do uzupelnienia], [ADRES POCZTOWY - do uzupelnienia], contact address: support@depositmonsters.com.

These terms use names from the game. They mean the following:

Reactivator: a player, that is a person using the app on their own account.
Reactivation Zone: a reverse vending machine marked on the map in the game. A Zone describes someone else’s device, of which we are neither the owner nor the operator.
Charge: an in-game value in three kinds (Amber, Spark, Prism). It is not money, has no value outside the game, and is not exchangeable for money or for any benefit outside the game.
Sparkling: the Reactivator’s creature, grown in the game using Charge and mini-games.
Capsule: the initial state of an account. Five settled receipts open it, and that is the only route to a Sparkling - it cannot be bought or obtained any other way.
Licence: a one-off, perpetual purchase removing full-screen adverts on the Reactivator’s account.

Conditions of use

The game may be used by people aged 16 and over. The game is not directed at children.
An account is required. It is created by signing in with a Google or Apple account, or with an e-mail address and a password.
No account is created without accepting these terms and confirming your age. That is a technical condition, not a declaration: the server refuses to create an account without both confirmations.
One person runs one account. An account may not be sold, lent or shared with third parties.
Using the game requires: a device running Android or iOS, an internet connection, a camera (receipt scanning) and permission to read your location at the moment you confirm presence at a machine.
The Reactivator is responsible for keeping their sign-in credentials secret.

Rules of the game and of Charge

The deposit belongs to the Reactivator. They collect the money from the receipt in the shop under the ordinary rules of the deposit scheme. The game does not act as an intermediary for the deposit, does not take it and has no access to it - it reads from the receipt only what is needed to award Charge.
One receipt is settled once. The barcode hash stored on the server side enforces this.
A receipt must be scanned after presence at a Zone has been confirmed, and its printing time must fall within the window of that presence. The scan may be submitted up to a day later.
The amount of Charge depends on the number and kind of containers, with diminishing rates for large bags (above a certain count a container counts for half, and beyond that not at all). The result screen says so outright.
Charge, the Sparkling, items and level exist only in the game. They do not constitute property in the legal sense and are not subject to payout or exchange for money.
Gameplay and everything that affects the outcome (mini-games, duels, the Charge ledger) is settled by the server. A result reported by the app is a claim, not a ruling.

Fair play

The following in particular are prohibited:

modifying the app, impersonating it and circumventing its mechanisms;
reporting a false location (so-called fake GPS) and confirming presence at a machine the Reactivator is not standing at;
settling someone else’s receipts, altered receipts and generated receipts;
using bots, scripts and emulators to play mini-games and duels;
creating multiple accounts in order to get around limits;
dropping pins for machines that do not exist, and reporting false faults.

The response to a breach is graduated and follows from what can be established with certainty:

An impossible run (for example a round reported faster than it could have lasted) is rejected.
An improbable run is flagged for a human to review, not rejected by an automated check. The cost of a false accusation can be higher than the cost of a missed suspicion.
A receipt that raises doubts is marked suspicious; the Charge is still awarded and support looks at the case.
Where breaches are confirmed, we may restrict access to some features, reverse improperly awarded Charge with a correcting entry, or block the account.

The Charge ledger is append-only: a correction is a new entry, not a change to history.

Adverts

The game is free and is funded by full-screen adverts served by Google AdMob and by licence sales. An advert never gives Charge or any advantage in the game.

Full-screen adverts appear only:

on the mini-game round summary, after the result has been shown;
on the Launcher match summary;
when leaving the games screen.

There are not and will not be adverts:

anywhere on the path at the machine, from choosing a Zone to the receipt result;
at the hatching of the Capsule and throughout a new player’s first day;
during care routines for the Sparkling;
on the map while looking for a machine;
at first launch, sign-in and consent screens.

Voluntary adverts, the ones a Reactivator starts themselves, remain available after the licence purchase as well and likewise give no Charge. The frequency of full-screen adverts is limited by a minimum interval between them and a daily cap.

How data is processed for advertising purposes is described in the privacy policy.

The perpetual licence

The licence is digital content sold as a one-off, non-renewing product in Google Play or the App Store. It is not a subscription.

What it gives: permanent removal of full-screen adverts on the Reactivator’s account, on every device of theirs.
What it does not give: not one unit of Charge, no item, no statistic, no faster hatching, no advantage in a duel. The licence buys quiet, not power.
The price is shown in the store, in the currency of the Reactivator’s country, and that is the binding price. The app reads it from the same place that takes the money.
The licence belongs to the account in our database, not to a device and not to a store account. It travels with the Reactivator to a new phone and between operating systems, but it does not transfer to another account in the game - not even after the previous one is deleted.
The app provides a Restore purchase button in case of a change of device.

Right of withdrawal

A consumer has the right to withdraw from a distance contract within 14 days without giving a reason.

Refunds and complaints

Refunds for the licence are handled by the store where the purchase was made: Google Play or the App Store. The request is submitted there, under that store’s rules.
A refund extinguishes the licence. We listen to store notifications; after a refund the adverts come back and the licence record stays with the status „refunded".
Complaints about how the game works, about awarded Charge and about the licence are accepted at support@depositmonsters.com. It helps to include the six-character account code from the challenges screen, a description of the matter and the date of the event.
We reply within 14 days of receiving a complaint.
Consumer rights arising from digital content not conforming to the contract remain unaffected [to be completed by the lawyer: reference to the applicable provisions].

Zones and the map

The map of Zones is built from pins dropped by Reactivators. A pin enters the shared map only after presence at the machine has been confirmed; an unconfirmed one is deleted after a day.
Reporting machines that do not exist, and dropping pins from anywhere other than the machine itself, is a breach of these terms: a map full of non-existent machines is worse than an empty map.
Charge is awarded for the first confirmed discovery of a machine. The number of paid discoveries per day is limited; exceeding the limit defers the payout to the next visit, and the machine enters the map regardless.
A broken machine can be reported from the Zone panel. One report does not switch a machine off - a Zone is marked with a warning only after reports from three different accounts in a short time. Reporting faults that do not exist is a breach of these terms.
We are neither the owner nor the operator of the reverse vending machines. We are not responsible for how they work, their opening hours, how full they are, or the content of the receipts they print.

Duels, gangs and the game on Roblox

A duel is arranged by two Reactivators. Entering a duel costs Charge and it is taken from both sides at the moment the time is agreed; the kind of Charge is determined by the discipline, not by the challenger.
A match that did not take place (it lapsed, was halted by a divergence, or ended in a draw) returns the stake. The fee is on winning, not on inviting.
Refusing and staying silent cost the same. A Reactivator who refuses or does not reply within 48 hours transfers Compensation in Charge to the challenger, and that challenger may not approach them for a week. Compensation moves Charge between accounts and never creates it.
A Sparkling cannot be permanently lost in any competitive mode.
A gang is chosen deliberately, by tapping a machine on the map. You belong to one gang at a time, and a change is possible no more often than once a week. Parts built into a gang accelerator are irreversible.
DepositMonsters Tycoon is a separate place on the Roblox platform, available once accounts are paired with a single-use code. It has not been released yet. Using it is subject to the terms and rules of Roblox Corporation, over which we have no influence. Account pairing is one-time; a mistake is corrected by support.
DepositMonsters is not affiliated with Roblox Corporation, nor sponsored or endorsed by it. Roblox is a trademark of Roblox Corporation.

Intellectual property

The game, its code, graphics, sound, texts, names and logos are protected by copyright and trademark law and belong to the service provider or are used under rights held by it.

The Reactivator receives a non-exclusive, non-transferable licence to use the app on their own devices, for their own use, within the scope of ordinary play.
Copying, decompiling, distributing and creating derivative works of the game are prohibited beyond the scope permitted by mandatory provisions of law.
Third-party materials (including map data and the trademarks of stores and platforms) remain the property of their owners and are used with the required attributions.
Recordings and screenshots from the game may be published for non-commercial purposes, with the game’s name given.

Liability and availability

The game is a service provided by electronic means and may be temporarily unavailable: because of maintenance, failures, updates or the operation of external providers. We make efforts to keep interruptions short and announced.
We are not responsible for how the reverse vending machines operate, their availability, opening hours, or the content of the receipts issued.
Receipt reading is automated and may fail on a poor photograph or a crumpled or faded receipt. In that case the app asks for a better photograph rather than awarding Charge at random.
You play on the move and in public space. The Reactivator is responsible for their own safety: the game does not encourage walking with a phone in front of your eyes, does not require haste and has no mechanic based on how fast you reach a machine.
The service provider’s liability is determined under generally applicable law; we neither exclude nor limit any consumer rights [to be completed by the lawyer: the scope of limitation of liability towards non-consumers].

Blocking and deleting an account

An account can be deleted by yourself, from within the app, and also by sending a request by e-mail. Both routes are described on a separate page: account and data deletion.
Deleting an account cannot be undone and means losing the Sparkling, Charge, items and game history. The licence does not transfer to a new account.
We may restrict access to an account or block it in the event of a gross or repeated breach of these terms, in particular fraud in settling receipts. A block can be challenged by writing to support@depositmonsters.com.
An account unused for a very long time may be deleted after prior notice [to be completed by the lawyer: whether, and after what period].

Changes to these terms

These terms may change for important reasons: changes in the law, changes in store rules, changes in the scope of the service or changes in the game itself. We will give notice of a change in the app before it takes effect. Continuing to use the game after that date means accepting the new version; anyone who does not accept it may delete their account. A change does not apply retroactively to purchases already made.

Governing law and disputes

These terms are governed by Polish law.
The choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the country of their habitual residence.
A consumer may use out-of-court complaint and redress mechanisms, including the assistance of a district (municipal) consumer ombudsman and the EU online dispute resolution platform (ODR) [to be completed by the lawyer: current status and address of the ODR platform].
Disputes with non-consumers are resolved by the court having jurisdiction over the service provider’s registered office.
